Over the years, we have successfully represented businesses and individuals in a number of different areas of the law. The following is a list of some of the types of cases we have successfully concluded.
Commercial Litigation
• Represented group of physicians who formed a company to purchase an MRI machine and personally guaranteed the loan for the machine, which failed to operate as warranted. Defended the claim by the lender and brought an action against the manufacturer for breach of warranty. Obtained favorable settlement after winning a motion to dismiss claims of fraud against the lender and manufacturer.
• Represented distributor of 31,000,000 fasteners allegedly defective and causing property damage throughout the United States. Defended claim by largest purchaser, instituted procedure for mitigating loss with respect to other potential claimants and brought claim against insurer. Obtained favorable settlement which permitted client to remain a financially viable company.
Environmental Litigation
• Acted as Co-Counsel in a case involving allegations that the client owed in excess of $26,000,000 as a potentially responsible party for clean-up of property rated number eight on the National Priorities List promulgated by the United States Environmental Protection Agency. Won judgment favoring client in United States District Court.
Labor and Employment
• Represented employer in alleged Americans with Disability Act and religious discrimination case. Obtained summary judgment, which was affirmed on appeal. Skorup v. Modern Door Corporation, 153 F.3d 512 (7th Cir. 1998).
• Represented public utility during contentious contract negotiations.
• Represented employer in arbitration proceedings involving discharge of employees for cause.
Professional Malpractice
• Represented a hospital in a medical malpractice case involving allegations emergency room physician failed to comply with the standard of care in treating an injury to a hand. Won defense verdict from jury.
• Represented family of patient who died as a result of the failure of a hospital to adhere to the standard of care. Negotiated settlement under California's MICRA statute.
Intellectual Property
• Represented inventor of product against Fortune 500 Company which had attempted to acquire patent by entering into exclusive purchase agreement and then breaching it, making it impossible for inventor to market product on his own. Obtained favorable settlement.
Real Estate
• Represented homeowners in action against sellers, real estate agent and broker, and various contractors in case involving non-disclosure of latent defects with home. Obtained very favorable settlement of case.
Product Liability
• Represented plaintiffs and defendants in complex products liability cases involving automobiles, appliances, exercise equipment, highway design, construction equipment, manufacturing equipment, forklifts, and the like.
